3. The basis and scope of the Seller's liability towards the Client who is a Consumer or Quasi-consumer if the sold Goods are non-conforming with the Agreement are defined by generally applicable provisions of law, in particular the Consumer Rights Act.

[In connection with amendments to regulations regarding statutory warranty and liability for non-conformity of goods with the agreement effective from January 1, 2023, the Seller informs that for agreements concluded before that date, including agreements concluded by Consumers or Quasi-consumers, the existing provisions of the Civil Code regarding statutory warranty apply.]

8. The Seller will respond to the Client's complaint promptly, no later than within 14 calendar days from the date of submission. The Seller will notify the complainant of the resolution via mail or e-mail, depending on the submission method.

If both repair and replacement are impossible or require excessive costs, the Seller may refuse to bring the Goods into conformity.

11. The Seller shall carry out the repair or replacement within a reasonable time from being informed of the non-conformity and without significant inconvenience to the Client. The costs of repair or replacement, including postage, freight, labor, and materials, shall be borne by the Seller.

12. The Client shall make the Goods subject to repair or replacement available to the Seller. The Seller will collect the Goods from the Client at its own expense.

13. If the Goods were installed prior to the non-conformity becoming apparent, the Seller shall remove the Goods and reinstall them after repair or replacement, or bear the cost of such operations.

14. The Client is not required to pay for the ordinary use of Goods that were subsequently replaced.

15. If the Goods are non-conforming with the Agreement, the Client who is a Consumer or Quasi-consumer may submit a statement requesting a price reduction or rescission of the Agreement when:

  • The Seller refused to bring the Goods into conformity in accordance with section 9;
  • The Seller failed to bring the Goods into conformity in accordance with sections 10–12;
  • The non-conformity persists despite the Seller's attempts to remedy it;
  • The non-conformity is substantial enough to justify an immediate price reduction or cancellation of the Agreement;
  • It is clear from the Seller's statement or circumstances that the Seller will not bring the Goods into conformity within a reasonable time or without significant inconvenience to the Client.

16. The reduced price must remain in proportion to the price under the Agreement as the value of the non-conforming Goods relates to the value of conforming Goods.

17. The Seller will refund the amounts due resulting from the exercise of the right to a price reduction promptly, no later than within 14 days from receiving the statement.

18. The Client may not rescind the Agreement if the non-conformity is minor. Non-conformity is presumed to be material.

19. If the non-conformity concerns only certain Goods delivered under the Agreement, the Client may rescind the Agreement only in respect of those Goods, as well as any other Goods acquired together if it cannot reasonably be expected that the Client would agree to keep only the conforming Goods.

20. In the event of rescission of the Agreement, the Client shall promptly return the Goods to the Seller at the Seller's expense. The Seller will refund the price no later than within 14 days from receiving the Goods or proof of return.

21. The Seller shall process the refund using the same payment method used by the Client, unless explicitly agreed otherwise without incurring additional fees.

22. Independent of statutory warranty rights, the Client may exercise rights arising from a commercial guarantee if such guarantee was provided for the Goods.

23. If a commercial guarantee is provided, details on exercising guarantee rights and the guarantor's identity are stated in the guarantee statement/document.

24. The guarantee does not exclude, limit, or suspend the Client's statutory rights regarding defects in sold goods.

25. Pursuant to Art. 558 § 1 of the Civil Code, the Seller's liability under statutory warranty for Goods towards Clients who are not Consumers or Quasi-consumers is excluded.
